Good News in an FAQ from DHS on OPT

You know you’re an immigration lawyer when an FAQ from the Department of Homeland Security regarding F-1 student and OPT issues during COVID-19 makes you happy. True, we may be punchy from all the Zoom meetings, but we will take it.  

Highlights include information on when and how F-1 students can use online and alternative instruction methods to maintain a full course load during COVID-19, the ability for schools to email I-20s to students, and the ability to accept scanned or digital signatures on I-20s (hello, 2020!).  

Something that will bring great relief to recent graduates and those graduating is that students currently participating in OPT, including STEM OPT, may work remotely if their employer has an office outside of the United States or the employer can assess student engagement using electronic means. This is a great relief to many!

Shhh don’t tell Senator Cruz that DHS is doing something rational.
